By creating an account or using Trakys Own (the “Service”) you agree to these Terms. If you do not agree, please do not use the Service.
1. Operator and brand
Trakys is a software product brand. The Service is operated by Mark Semikhov Software (the “Operator”), a sole proprietorship registered in Poland. When you subscribe, pay, or enter into a contract for the Service, you contract with the Operator, not with a separate company using the Trakys brand.
2. The Service
Trakys Own is a personal productivity and finance tracking tool. Features may change without notice. We may suspend or discontinue any feature at any time. The Service is an early-stage product and is provided without any enterprise service-level commitment unless we agree otherwise in writing.
3. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. You must be at least 16 years old to use the Service. Provide accurate registration information.
4. Acceptable use
You may not:
- upload illegal content or content that infringes someone else’s rights;
- attempt to disrupt, reverse-engineer, scrape, or overload the Service;
- use the Service to send spam or malware;
- resell or sublicense access without our written consent.
5. Subscriptions and payment
Paid plans are billed in advance through Stripe and renew automatically until you cancel. You can cancel anytime from your billing settings or by contacting us; the plan stays active until the end of the current period. Unless mandatory law says otherwise, fees are non-refundable once a billing period starts. Your bank statement descriptor may show TRAKYS or a similar variant identifying the product and Operator.
6. Markets and eligibility
The Service is currently intended primarily for users in the United States, Poland, and Ukraine. We may allow registrations from other countries at our discretion. You are responsible for ensuring that your use of the Service is lawful where you are located.
7. Your content
You retain ownership of everything you upload. You grant us a limited license to store and display your content solely to operate the Service for you. We do not sell or share your content with advertisers.
8. Restricted regions
The Service is not available to users in countries subject to comprehensive sanctions, including the Russian Federation, Belarus, North Korea, Iran, Syria, Cuba, and the occupied regions of Ukraine. By signing up, you confirm you are not located in or a resident of those regions.
9. Termination
You can request account deletion at any time. We can suspend or terminate accounts that violate these Terms. After termination, we delete or anonymize account data within a commercially reasonable period, except where retention is required by law or reasonably necessary for security, fraud prevention, or billing disputes.
10. Disclaimers
The Service is provided “as is”, without warranties of any kind. We do not guarantee that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, our liability is limited to the amount you paid us in the 12 months preceding the claim.
11. Governing law
Unless mandatory consumer law in your place of residence says otherwise, these Terms are governed by the laws of Poland, without regard to conflict of laws principles.
12. Changes
We may update these Terms from time to time. If a change is material, we will use reasonable efforts to notify you in advance by email or in-app notice. Continued use after the updated Terms take effect constitutes acceptance.
